Depending on the services provided and the relationship between Qube AI and the relevant business or individual, Qube AI may act in different capacities.

Service Provider / Processor

Where Qube AI processes personal information on behalf of a business customer, Qube AI generally acts as a service provider, processor, contractor, or similar role under applicable privacy law.

In those circumstances, the business customer generally determines:

  • What information is collected;

  • Why the information is collected;

  • How the information is used;

  • How long the information should be retained; and

  • What instructions Qube AI must follow regarding that information.

Qube AI will process such information in accordance with the applicable agreement, documented instructions, and applicable law.

Qube AI may act as a business or controller where we independently determine the purposes and means of processing personal information, including in relation to our own website, marketing, account management, service administration, security, and business operations.

Depending on the configuration of the service, Qube AI may use artificial intelligence to evaluate calls against criteria established by the relevant business customer.

  • Questioning technique;

  • Use of open or closed questions;

  • Sales methodology;

  • Objection handling;

  • Call structure;

  • Compliance with internal procedures;

  • Other customer-defined performance criteria.

Qube AI may generate:

  • Scores;

  • Summaries;

  • Coaching recommendations;

  • Performance reports;

  • Quality assurance assessments;

  • Other analytical outputs.

These outputs may relate to employees, contractors, sales representatives, customer service representatives, customers, prospects, or other individuals participating in the relevant communication.

Where Qube AI provides this functionality to a business customer, the customer is generally responsible for determining whether its use of call recording, monitoring, employee evaluation, AI analysis, and related processing is lawful and appropriately disclosed.

Qube AI will not intentionally use customer call recordings for unrelated purposes or independently repurpose such recordings outside the scope of the applicable agreement or the customer's documented instructions, except where necessary to comply with law, protect our services, or otherwise permitted by applicable law and contract.

4. CALL RECORDING AND MONITORING

Call recording and monitoring laws vary by jurisdiction.

Some jurisdictions require the consent of one party to a communication, while others may require consent from all parties to certain recorded communications.

For example, California law can require the consent of all parties to a confidential communication before it is recorded.

Accordingly, businesses using Qube AI are responsible for determining and implementing appropriate recording notices, consent mechanisms, disclosures, and procedures based on:

Customers remain responsible for configuring their systems appropriately and obtaining any notices, permissions, or consents required by law.

  • Call analysis systems;

  • Training systems;

  • CRM integrations; and

When you interact with a Client using Qube AI technology, the Client may be responsible for determining the purposes and methods of processing your personal information.

For example, if you call a company that uses a Qube AI voice agent, the company may determine:

  • Whether your call is recorded;

  • Whether your call is transcribed;

  • How the information is used;

  • How long it is retained; and

Qube AI may process the information on behalf of that Client as a service provider, processor, contractor, or similar role.

Providing your telephone number, submitting an enquiry, requesting information, booking an appointment, or interacting with an AI system does not automatically constitute consent to receive marketing calls or messages where separate consent is required by applicable law.

Where Qube AI or a Client sends or initiates communications, the parties will seek to comply with applicable federal and state communications laws.

  • Artificial or prerecorded voice calls;

Businesses using Qube AI remain responsible for reviewing AI-generated information before making significant employment, customer, financial, legal, or other decisions where human review is required or appropriate.

10. SENSITIVE AND BIOMETRIC INFORMATION

Certain information may receive additional protection under applicable law.

This may include, depending on the jurisdiction:

  • Precise geolocation;

The Client using Qube AI is generally responsible for ensuring that its use of employee or worker information complies with applicable employment, workplace monitoring, privacy, biometric, recording, and other laws.

Qube AI will process such information in accordance with the applicable agreement and documented instructions.

Our websites and services may use cookies, pixels, analytics tools, local storage, and similar technologies.

These technologies may be used for:

  • Website functionality;

  • Security;

  • Analytics;
